# StarNight Acceptable Use Policy

This Acceptable Use Policy ("AUP") sets out the rules for using the StarNight platform and services ("Service"). It applies to all users, including consumers and business/Organizer accounts. It supplements the Terms of Service and Privacy Policy.

By using the Service you agree to comply with this AUP. We may suspend or terminate accounts and take other action for violations.

1. Lawful Use Only

You may use the Service only for lawful purposes and in accordance with all applicable laws of the Republic of Kosovo and any other jurisdiction from which you access the Service.

You must not use the Service:

  • To commit, assist, or encourage any criminal or fraudulent activity.
  • To infringe any third-party rights (including intellectual property, privacy, publicity, or data protection rights).
  • To send or upload any material that is defamatory, obscene, offensive, hateful, or inflammatory.
  • To harass, abuse, or harm any person (including other users, venue staff, or attendees).

2. Accuracy of Information

You must provide accurate, complete, and up-to-date information when creating an account, purchasing tickets, requesting tables, listing events (for Organizers), or submitting any other content or data.

In particular:

  • Ticket holder details (name, date of birth, gender) must be true and must match the official identification of the person who will actually attend.
  • Business/Organizer information (venue details, tax ID, IBAN, event descriptions, age restrictions, refund policies) must be accurate and kept current.
  • You must not create fake accounts, impersonate others, or misrepresent your identity or affiliation.

3. Tickets, Entry, and Capacity

  • You must not attempt to circumvent ticket limits, inventory holds, mapped seating rules, or any security or anti-fraud measures.
  • You must not resell or transfer tickets except where expressly permitted by the Organizer and the Service.
  • At the venue, you (and any ticket holders) must comply with the Organizer's entry rules, house rules, and the instructions of venue staff. Denied entry due to mismatched ID, intoxication, or violation of venue rules is not grounds for a platform refund.
  • Business users must use the QR scanner and check-in tools only for legitimate entry verification and must not misuse attendee data.

4. Content and UGC (Stories, Highlights, Profiles, Ratings)

  • You are responsible for all content you upload, capture, or publish through the Service (including stories, highlights, profile photos, ratings, and comments).
  • Content must not be illegal, infringing, or harmful.
  • Stories and highlights captured at a venue are intended for the context of that event/venue. Do not capture or share material that invades the privacy or dignity of others in a way that violates law or this AUP.
  • Ratings and reviews must be genuine and based on your actual experience.

We reserve the right (but have no obligation) to review, remove, or moderate content that violates this AUP or the Terms.

5. Technical and Security Rules

You must not:

  • Access or attempt to access any part of the Service, servers, or databases that you are not authorized to access.
  • Scrape, crawl, data-mine, or use automated means to extract data (except as expressly permitted by robots.txt or API documentation we publish).
  • Introduce viruses, malware, or other malicious code.
  • Interfere with or disrupt the Service, its security, or the experience of other users (including by flooding, spamming, or excessive API calls).
  • Attempt to reverse-engineer, decompile, or derive source code except where permitted by law.

6. Business / Organizer Specific Rules

If you use the Service as a business or Organizer:

  • List only events and venues you are legally authorized to promote and host.
  • Provide clear, accurate age restrictions, refund policies, and event details.
  • Use attendee data received through the Platform solely for entry control, capacity management, and fulfilling the event — not for unrelated marketing or other purposes.
  • Comply with all applicable laws regarding the events you host (capacity, safety, licensing, consumer protection, data protection for attendee lists, etc.).
  • Settle any obligations to StarNight (e.g., Top 10 promotion fees) on time.

7. Payment and Financial Integrity

  • You must not engage in any activity intended to defraud, reverse legitimate charges, or abuse the payment or refund systems.
  • Business users must provide accurate IBAN details for settlement and must not misrepresent financial information.

8. Respect for Others

  • Do not use the social or notification features to spam, stalk, or send unwanted communications.
  • Do not share another person's personal data (including photos in which they are clearly identifiable) without a lawful basis.

9. Reporting Violations

If you see content or behavior that violates this AUP or the Terms, please report it through the in-app reporting tools or Help & Support. We investigate reports and take appropriate action.

10. Consequences of Violation

We may take any action we consider appropriate, including:

  • Issuing warnings.
  • Removing or disabling content.
  • Suspending or permanently terminating accounts (including business accounts and associated events).
  • Reporting to law enforcement or relevant authorities.
  • Taking legal action to protect our rights and the rights of users and Organizers.

11. Changes

We may update this Acceptable Use Policy from time to time. Continued use of the Service after changes constitutes acceptance.
